ESA in Montana

Montana does not currently have an ESA program.

Montana's Special Needs ESA exists in law but was blocked by a court ruling in December 2025. Montana does offer a tax credit scholarship, but it is not available to homeschool families.

Special Needs ESA — blocked by court (December 2025)
Montana enacted a Special Needs ESA (HB 393) that was blocked by a district court on December 8, 2025. The state is appealing. As of April 2026, $0 has been disbursed and no students are enrolled. Check opi.mt.gov for updates.
Tax Credit Scholarship (HB 279)
$150 individual tax credit for donations to Student Grant Organizations (SGOs). $1M annual cap. Funds private school tuition only — not available for homeschool families.
